Please note that what follows is just an excerpt - whose function is merely illustrative - of the terms contained in our full Publication Agreement. The omission in the former of some of the terms contained in the latter shall under no circumstances amount to a waiver of such terms, on the part of the ILSU Wps Editorial Board.

Publication Agreement Excerpt

As a condition for publication on the Italian Legal Scholarship Unbound Working Paper Series (hereinafter “ILSU Wps”) of accepted papers, authors are required to grant and/or assign the following rights to the ILSU Editorial Board:

  • to publish the work one time in the ILSU Wps (www.ilsuwps.org);
  • to publish, reproduce, transmit, and distribute the work through SSRN (www.ssrn.com), Bepress SelectedWorks (http://works.bepress.com/ilsu_working_paper_series) or any other computer-assisted research system or digitized database or service with which the ILSU Wps has or develops an agreement as long as the publication credits the author and contains noticeof the author’s retention of copyright. Such rights shall be non-exclusive and shall continue inperpetuity ;
  • to retain any fees that the ILSU Wps Editorial Board might receive for any publication inaccordance with any of these rights;
  • to request reasonable and/or necessary editorial changes in the work, including, but not limited to, adding footnotes;
  • to request compliance with agreed upon deadlines, and to request sources not available to the Editorial Board;
  • to terminate the publication agreement should the author violate the plagiarism policy of the ILSU Wps or any of the rights, duties and/or warranties granted in this agreement. The Editorial Board considers plagiarism to be the intentional, knowing, reckless, or negligent useof another person’s words, phrases, citations, ideas, arguments, or organization (1) in a manner that improperly creates the impression that they originated with the writer or (2) otherwise without proper attribution.
  • to publish subsequent errata sheets or notifications of errors as reasonably determined necessary in the discretion of the Editorial Board.

The ILSU Wps Publication Agreement further requires that authors:

  • represent and warrant that the work does not defame any person, does not invade the privacy of any person, and does not in any other manner infringe upon the rights of any person, and they further agree to indemnify and hold harmless the ILSU Editorial Board against all such claims;
  • represent and warrant that they have full power and authority to license the article to the ILSU Wps and they further agree to hold harmless the Editorial Board, their licensees and distributees, from any claim, action, or proceeding alleging facts that constitute a breach of any warranty enumerated in this paragraph.

At any rate, the Editorial Board retains the right to terminate the publication agreement and remove the work from its distribution channels (such as – but not limited to - the official ILSU website, SSRN database and Bepress SelectedWorks repository).

Aside from those rights expressly granted to the ILSU Wps, authors retain copyright and any ther right in their works: this includes the right to license published working papers to other law reviews. In this respect, the ILSU Wps undertakes to acknowledge subsequent publication of the work in all of its distribution channels.

The ILSU Wps Editorial Board promises to make a good faith effort to publish the work in a timely manner, and authors should further make reasonable efforts to ensure that subsequent final publication of the work in another law review bears the legend, “A previous version of this work has appeared in the ILSU Working Paper Series (www.ilsuwps.org)".
